I don't know for sure, but if you think about it it makes sense that it would always have been the case. If somebody was born "Smith" and then got married to another "Smith", after a divorce would they have to change their name to "Smith... but not that Smith"? I know that's an absolutely ridiculous example, but you get the point. I can change my name to Presley if I want, so why can't Priscilla retain the name Presley?
